WACO, Texas — A San Marcos murder suspect is one of three men accused of setting a fire at the Jack Harwell Detention Center in Waco during an alleged escape attempt, according to the Waco Tribune.
Kyle Sample, 20, will be charged with arson and attempted escape along with two other inmates, Brandon Aaron Fritze and Andrew Ruben Martinez, the McLennan County Sheriff’s Office told the newspaper.
As of Friday, Fritze was the only one formally charged, though the sheriff’s office reportedly said they are in the process of charging Sample and Martinez.
Several inmates told investigators they saw the trio start the fire on June 30, which only ended up causing minor damage. They reportedly used a an electrical outlet, toilet paper and an empty toothpaste tube to spark the blaze.
Sample was in the Harwell Detention Center while awaiting trial for a fatal shooting of a 28-year-old man outside a San Marcos laundromat in June 2017, according to the report.
Martinez, of Kyle, is also facing a murder charge in Hays County. He’s accused of shooting a 19-year-old man in Kyle.
Fritze, who was transferred to McLennan County Jail, was arrested last year by Waco on multiple charges that include aggravated assault, fraud and retaliation.
Sample and Martinez will reportedly be sent back to Hays County Jail.
